SpringSpot Inc. (“SpringSpot,” “we,” “our,” and/or “us”) values the privacy of individuals who use our website and mobile application (collectively, our “Services”). This privacy policy (the “Privacy Policy”) explains how we collect, use, and share information from users (“Users”) of our website, mobile application, and services, including classes we offer (“Services”). By using our Services, you agree to the collection, use, disclosure, and procedures this Privacy Policy describes. Beyond the Privacy Policy, your use of our Services is also subject to our Terms of Service.

Family Plan Privacy
Information We Collect
We may collect a variety of information from or about you or your devices from various sources, as described below.
1. Information You Provide to Us.
Registration and Profile Information. When you sign up for an account, register to use our Services, sign up for notifications or updates, or participate in our surveys, we may collect information that you provide directly to us. This information may include your name, email address, password, phone number, home address, date of birth, gender, and names and ages of children. We may also ask you for information related to health conditions or medications that could affect your participation in our class offerings.
Class and Workout Information. We collect information about the classes that you attend. We may also collect information about your workout preferences, such as preferred exercises. If you provide this information directly to one of our instructors, we may associate this information with your account.

Fitness Assessment Information. When available, if you choose to have us conduct a fitness assessment, we collect information to assist in that fitness assessment such as your age, gender, height, weight, body mass index, body composition, strength, and flexibility.
Your Contacts. To create and register for our Services and participate in one of our classes, you may also need to provide us with the name and phone number of an individual to serve as an emergency contact. We may also ask you to provide your friends’ information so that we can, for example, invite them to try our classes.
Communications. If you contact us directly, we may receive additional information about you. For example, when you contact us for customer support, we will receive your name, email address, phone number, the contents of a message or attachments that you may send to us, and other information you choose to provide. If you join our mailing list, then we will collect certain information from you, such as your email address. When we send you emails, we may track whether you open them to learn how to deliver a better customer experience and improve our Services.
Purchase and Payment Information. If you make a purchase through our Services, we collect your purchase information and payment-related information, such as credit card or other financial information and address. This information is collected by our third party payment processor on our behalf. We do not store full payment card numbers on our systems; payment card data is handled directly by our third-party payment processor(s) acting as data sub-processors on our behalf, and their collection and use of your payment information is governed by their own privacy policies. If you access content provided by a Creator and fees are collected in connection with that access, whether through SpringSpot’s payment services or directly by the Creator, the applicable payment processor may receive transaction information including the amount paid and a description of the content or service purchased.
Creator Program Information. If you participate in the SpringSpot Creator Program as a Creator, we collect additional information from you, including: (a) information about the Creator Content you publish through our Services, including content metadata, access settings, and audience configurations; and (b) if you use SpringSpot payment services, transaction information related to fees collected from your audience, including payment amounts, dates, and identifiers associated with those transactions.
2. Information We Collect When You Use Our Services.
Device Information. We receive information about the device and software you use to access our Services, including IP address, domain name, web browser type, operating system version, phone carrier and manufacturer, application installations, device identifiers, mobile advertising identifiers, and push notification tokens.
Usage Information. To help us understand how you use our Services and to help us improve it, we automatically receive information about your interactions with our Services, such as the pages or other content you view, the searches you conduct, the length of time you visit our Site and/or use our Services, the links you click, your IP address, the URL or website that led you to our website, and purchases you make.
Information from Cookies and Similar Technologies. We and third party partners collect information using cookies, web beacons, pixel tags, or similar technologies, including technologies designed for mobile apps. We combine this information with other information we collect about you to identify you across multiple devices. We also use this information to track the activities of our website visitors and mobile users, help us manage content, and compile statistics about our Services usage. We also use clear GIFs in HTML emails to our customers to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded. We also use third party SDKs to, among other things, track our conversions and associate with your account how you use our Services when you are not logged in to the account.

To personalize your experience with our Services, such as by providing tailored content and recommendations, and to provide location customization, personalized help and instructions, and to otherwise personalize your experiences while using the Services;

To research, understand, and analyze how you use our Services and develop new products, services, features, and functionality;

To communicate with you, provide you with updates and other information relating to our Services, provide information that you request, respond to comments and questions, and otherwise provide customer support;

For marketing and advertising purposes, such as developing and providing promotional and advertising materials that may be relevant, valuable or otherwise of interest to you (see Your Choices for more information on how to opt out of certain marketing activities);

To facilitate transactions and payments;

To investigate, prevent or take action regarding illegal activities, to find and prevent fraud, respond to trust and safety issues that may arise, and protect us and others;

For compliance purposes, including enforcing our Terms and Conditions or other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency; and

To share your in-app activity information with Creators whose pages you access, to support your training, wellness, or health improvement goals, as further described in the Creator Program Privacy section below.

How We Share the Information We Collect

We may share your information, including personal information, as follows:

Affiliates. We may share any information we receive with our affiliates for any of the purposes described in this Privacy Policy. Our affiliates’ use and disclosure of your personal information will be subject to this Privacy Policy.

Vendors and Service Providers. We may share any information we receive with vendors and service providers retained in connection with the provision of our Services or that perform business functions on our behalf, such as advertising our services and products.
Payment Processors. We use one or more third-party payment processors to handle payment transactions made through our Services. When you make a purchase or when a Creator collects fees in connection with access to their content, we share necessary transaction information with our payment processor(s), including your name, billing address, payment card information, and purchase details. Our payment processor(s) act as data sub-processors and their collection and use of your information is subject to their own privacy policies. We do not store full payment card numbers on our systems. If SpringSpot payment services are made available to Creators, we may also share Creator payout information with our payment processor(s) to facilitate disbursements.
Creators. When you access a Creator’s page or Content within the SpringSpot platform, we may share certain information about your in-app activity with that Creator to support your training, wellness, or health improvement goals. The information we share may include activity completions, guide completions, workout history, and progress data associated with Content provided by that Creator. This sharing is intended to allow Creators to tailor their Content and guidance to your needs. Creators are required by our Terms of Service to keep your information confidential and to use it only for purposes related to supporting your use of their Content on SpringSpot. Creators are not permitted to use your information for independent marketing or to share it with third parties. Please see the Creator Program Privacy section below for more information.

Analytics Partners. We use analytics services such as Google Analytics to collect and process certain analytics data. You can learn about Google’s practices by going to https://www.google.com/policies/privacy/partners/, and opt-out of them by downloading the Google Analytics opt-out browser add-on, available at https://tools.google.com/dlpage/gaoptout. These third party analytics services help us understand how users access and use our Services, so we can improve the user experience, and provide more personalization.
Joint Marketing Partners. With your consent, we may share your information with our joint marketing partners.
As Required By Law and Similar Disclosures. We may access, preserve, and disclose your information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others’ rights, property, or safety.
Merger, Sale, or Other Business Transfers. We may transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our assets. We may also transfer your information as part of a bankruptcy proceeding. The use of your information following any of these events will be governed by the provisions of this Privacy Policy in effect at the time the applicable information was collected.
Aggregate and De-Identified Information. We may share aggregate information about users with third parties for marketing, advertising, research or similar purposes.

Consent. We may also disclose your information with your permission.

Creator Program Privacy
Activity Visibility for Creators. When you access a Creator’s page on SpringSpot and engage with Content provided by that Creator, the Creator may be able to view certain information about your in-app activity. This information may include activity completions (such as completed workouts or exercises), guide completions, progress toward goals, and other engagement data associated with the Creator’s Content. This visibility is provided to allow the Creator to monitor your progress and tailor their Content, programs, or guidance to better support your training or health goals. The Creator’s ability to view your activity is limited to activity associated with their own Content and does not extend to activity on other Creators’ pages or to unrelated areas of the SpringSpot platform. By accessing a Creator’s page and engaging with their Content, you consent to this sharing of your activity information with that Creator.
Creator Obligations. Creators who participate in the SpringSpot Creator Program are required by our Terms of Service to treat your activity information as confidential and to use it only for the purpose of supporting your engagement with their Content on SpringSpot. Creators are prohibited from using your activity information for their own independent marketing purposes or from sharing it with third parties outside of SpringSpot. SpringSpot is not responsible for a Creator’s misuse of your information, but we take violations of these obligations seriously and may terminate a Creator’s access to the platform for non-compliance.
Leaving a Creator’s Page. If you leave a Creator’s page or your access to that Creator’s Content ends for any reason, the Creator will no longer receive updates about your activity going forward. However, activity information already shared with the Creator prior to your departure will remain accessible to the Creator unless you contact us to request otherwise at privacy@gospringspot.com.

Your Choices
Location Information. You can prevent your device from sharing precise location information at any time through your device’s operating system settings.
Marketing Communications. You can unsubscribe from our promotional emails by following the opt-out instructions in the emails. Please note that it may take up to 10 business days for us to process opt-out requests. Even if you opt-out of receiving promotional messages from us, you will continue to receive administrative messages from us.
Do Not Track. There is no accepted standard on how to respond to Do Not Track signals, and we do not respond to such signals.

Third Parties

Our Services may contain links to other websites, products, or services that we do not own or operate. We are not responsible for the privacy practices of these third parties. Please be aware that this Privacy Policy does not apply to your activities on these third party services or any information you disclose to these third parties. We encourage you to read their privacy policies before providing any information to them.

Security
We make reasonable efforts to protect your information by using physical and electronic safeguards designed to improve the security of the information we maintain. However, as no electronic transmission of information can be entirely secure, we can make no guarantees as to the security or privacy of your information. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.
Children’s Privacy

We do not knowingly collect personal information directly from children under 13 years old, except through the Family Plan feature as described below, where a parent or legal guardian (the “Organizer”) adds a Child Family Member to their Family Plan and provides verifiable parental consent on that child’s behalf. If you learn that a child under 13 has provided us with personal information outside of the Family Plan without parental consent, please alert us at privacy@gospringspot.com and we will delete that information promptly.​Updating Your Information​

Family Plan Privacy
Family Plan Information We Collect. When an Organizer establishes a Family Plan, we collect information about the Organizer’s Family Members as follows. For Adult Family Members (18+) and Teen Family Members (13–17), we collect the information they provide when accepting their invitation, including their display name or username, and we collect activity data associated with their use of our Services, including task completions, activity completions, guide completions, and progress data. For Child Family Members (under 13), we collect only the minimum information necessary to provide the Services: a chosen display name or username (not a real name), activity completions, task completions, badge and achievement data, and age range (under 13).
Organizer Visibility. The Organizer of a Family Plan can view the activity data, task completion status, badges, and achievements of all Family Members on their plan. This visibility applies to Adult, Teen, and Child Family Members alike. For Child Family Members, this visibility is a core feature of the parental supervision function of the Family Plan and forms part of the basis for the Organizer’s verifiable parental consent. Adult and Teen Family Members who accept a Family Plan invitation acknowledge that their activity information will be visible to the Organizer as a condition of being part of that Family Plan.

Parental Rights and Data Deletion. As the Organizer and parent or legal guardian of a Child Family Member, you have the right to: (a) review the personal information we have collected about your child by contacting us at privacy@gospringspot.com; (b) request correction of inaccurate information about your child; (c) request deletion of your child’s personal information at any time by contacting privacy@gospringspot.com, which we will fulfill within thirty (30) days; and (d) revoke your consent to our collection of your child’s information by removing the Child Family Member from your Family Plan and requesting data deletion. Please note that revoking consent and requesting deletion may limit or eliminate the child’s ability to use the Services. To exercise any of these rights, please contact us at privacy@gospringspot.com.
Verifiable Parental Consent. When an Organizer adds a Child Family Member to their Family Plan, SpringSpot obtains verifiable parental consent through an in-app verification step during the child profile setup flow. The Organizer is required to confirm their identity as an adult using the payment method associated with their Account. By completing this verification, the Organizer confirms that they are the parent or legal guardian of the Child Family Member and consents to SpringSpot’s collection and use of that child’s information as described in this Privacy Policy.

Updating Your Information
You can access and update your account and profile information through your profile settings.

Changes to this Privacy Policy
We will post any adjustments to the Privacy Policy on this page, and the revised version will be effective when it is posted. If we materially change the ways in which we use or share personal information previously collected from you through the Services, we will notify you through the Services, by email, or other communication.
